Is Online Poker Legal in North Carolina?
No. Section 14-292 makes it a Class 2 misdemeanor to operate a game of chance or to play at or bet on one, and the exceptions it lists are short and closed: Chapter 18C, which covers the lottery and sports wagering, plus the bingo, raffle and game night provisions elsewhere in Article 37. Online poker appears in none of them. That game night line is a verified absence rather than an oversight in the research. Search the full text of Article 37 and no age requirement appears for any charitable game. The practical gate is indirect: a game night has to happen inside a facility holding an on-premises alcohol permit, which imposes its own rules at the door.
On an unregulated account, the age that counts is the one printed in the terms, not the one the registration page waved through. A 19-year-old’s deposit clears without friction. Those field sizes put Cherokee among the biggest Circuit stops anywhere in the country. A $1,700 buy-in drawing 1,824 runners is not a regional curiosity; it pulls from Atlanta, Knoxville, Greenville and every corner of both Carolinas. Charity Poker and Game Nights in North Carolina
This is the one place North Carolina law says yes to poker outside a casino, and the yes comes wrapped in more conditions than any other state’s charitable gaming scheme. Part 4 of Article 37 took effect June 1, 2019, and Alcohol Law Enforcement administers it. The permit process and forms run through ALE headquarters rather than a gaming board.
What the law permits an organization to do:
- Qualify by existing continuously for five years and holding 501(c)(3), (c)(4), (c)(5) or (c)(6) status
- Hold four events per calendar year, no more than one per quarter, none longer than five hours
- Run exactly six games and no others: poker, blackjack, roulette, craps, a simulated horse race, and a merchandise wheel of fortune
- Pay $100 per event, applying at least 30 days ahead, and hire a vendor holding a $2,500 annual permit
- Register every piece of equipment with a $25 sticker, renewed yearly, with unregistered gear a Class 1 misdemeanor
And the restriction that surprises everyone: no game may be played for cash or a cash prize. Chips convert to raffle tickets, and prizes come out of the raffle. A bank-issued gift card counts as cash for this purpose. So a charity hold’em night is legal in North Carolina, and a charity hold’em night that pays the winner money is not.
The I-26 Line
Section 14-309.33 confines the entire scheme to “areas of the State located east of I-26 as that interstate highway was located on November 28, 2011.” Charity poker is lawful in Raleigh, Durham, Charlotte and Wilmington. It is unlawful in Asheville, Hendersonville and everything west. The boundary is a road, frozen at its position on one particular Monday fifteen years ago.
That date is not random. November 28, 2011 is when the Eastern Band announced the compact terms that gave the tribe exclusive rights to live gaming west of I-26, and the legislature drew the charity law to stop short of that territory. A church in Weaverville cannot run a poker fundraiser because of a casino two counties away.
Home Poker Games in North Carolina
North Carolina wrote no social gambling exemption. Not a capped-stakes carve-out, not a private-residence defense, not a no-rake safe harbor. Section 14-292 reaches “any person who plays at or bets on any game of chance,” and there is no dollar floor beneath which it stops applying. A quarter-ante dealer’s choice game in a Cary basement is, on the page, a Class 2 misdemeanor for everyone at the table.
Two older provisions sharpen the point. Section 14-297 makes it an offense to knowingly permit a gaming table in your house, and the same sentence says the host “shall forfeit and pay to any one who will sue therefor two hundred dollars.” That clause traces to an act of 1798 and sits in the code today, untouched since 1994. No North Carolina appellate decision has ever construed it, so treat it as a strange live provision rather than a remedy anyone has actually run. Section 14-293 covers bars and restaurants, where a conviction bars the keeper from the trade permanently and the court must write the forfeiture into its judgment.
Raids, and the Bill That Would Have Fixed It
Enforcement lands where you would expect, on games with money coming off the top, but North Carolina has hit ordinary ones too. On November 10, 2006, officers raided a house on Tarheel Club Road in Raleigh, charged fifteen people, and seized more than $40,000 in cash.
The legislature came close to changing this in 2025. House Bill 424 would have protected private games of cards, tiles and dice where nobody profits beyond their own winnings, no machines appear, and the game runs no more than one day in seven at any location. It cleared the Judiciary committee twice, went to Rules on April 15, 2025, and died there. One detail in the drafting deserves attention: the bill named canasta, mahjong and bridge, and never once said poker.
The Machines North Carolina Banned, and the Ones It Keeps Seizing
No state dismantled a legal gambling industry more completely than this one. Video poker operated lawfully in North Carolina for years under a licensing scheme; then a 2006 session law repealed it and phased the machines out on a schedule, two per location that October, one the following March, and a flat prohibition on July 1, 2007. Estimates at the time put 10,000 legal machines and perhaps twice that many unlicensed ones across the state.
The statute carved out exactly one exception: federally recognized tribes operating under a Class III compact. North Carolina banned video poker for everybody except Cherokee, which is the clearest single statement of gambling policy this state has ever made.

House Bill 999 proposed licensing and taxing the terminals instead. It never left committee.

Will North Carolina License Online Poker?
Not soon, and the honest reason is that nobody has asked. No iGaming, online casino or internet poker bill was introduced in the 2025 or 2026 sessions. The longer-term shape is easier to see. If North Carolina ever licenses internet poker, its population of 11 million would make it the second-largest regulated market in the country behind Pennsylvania, and joining the interstate compact would let it pool players immediately with the four-state network where poker sites in Michigan already share tables. Danville is the answer for most of the state, and it is the answer for both major cities at once, roughly two hours from Charlotte and an hour and a half from Raleigh. The rest of the border gives a North Carolina player very little:
