Is Online Poker Legal in Florida?

No state agency licenses an online poker room in Florida, and nothing in Florida law creates a path for one. The right word for what players use instead is “unregulated,” not “legal.”

Chapter 849 of the Florida Statutes handles gambling offenses, and the legislature wrote it for a physical world. Section 849.01 criminalizes keeping a gambling house, a third-degree felony that carries up to five years. Section 849.08 makes playing a game of chance for money a second-degree misdemeanor. Neither section says a word about a laptop. No reported Florida case has ever charged a resident over a hand dealt on a website, and prosecutors have shown no appetite for building one.

Cardrooms escape all of that through a carve-out. Section 849.086 pulls poker and dominoes out of the general prohibition, reasoning that the money at a poker table moves between the people sitting at it and never into the operator’s own action, and the legislature wrote directly into the statute that these games count as pari-mutuel style rather than casino gaming. Read the section closely and one thing jumps out: it authorizes games at a licensed facility, on premises, under the eye of a state inspector. There is no version of that framework that a website could satisfy.

The Seminole Compact Blocks the Obvious Fix

Florida signed a 30-year compact with the Seminole Tribe in 2021, and that document is the real obstacle. It handed the tribe exclusive rights over statewide mobile wagering by deeming every bet placed anywhere in Florida to occur on tribal land, where the servers sit.

A federal district court threw the compact out in November 2021. The D.C. Circuit reversed that ruling in June 2023, the tribe relaunched Hard Rock Bet on December 7, 2023, and the Supreme Court refused to hear the challenge on June 17, 2024. The compact survived every attack. Between December 2023 and May 2024 alone, the tribe sent $357 million to the state, which tells you how motivated Tallahassee is to leave the arrangement alone.

Hard Rock Bet takes sports wagers. It runs no poker room, and the compact never contemplated one. Any lawmaker who proposes licensing online poker for anyone else is proposing to tear a hole in the deal that generates that revenue.

Where the Legislature Stands

Two straight sessions produced noise and nothing else. Representative Walter Barnaby filed HB 953 on February 24, 2025, and Senator Corey Simon followed with SB 1404 two days later, both aiming to fold internet gambling and internet sports wagering into the criminal code as third-degree felonies. The Senate Regulated Industries Committee passed Simon’s version 8-0. Then the session ended.

The 2026 attempt aimed higher and still collapsed. Representative Berny Jacques filed HB 591, which would have shut down every form of gaming outside the Seminole compact, sweepstakes platforms included, and it died in the Industries and Professional Activities Subcommittee without a floor vote. A broader Senate gaming bill, CS/SB 204, cleared two committees unanimously and then died in Rules. Both expired on March 13, 2026, and not one gambling measure reached the governor’s desk that year.

Notice the direction of travel. Nobody in Tallahassee has filed a serious bill to license online poker. The filed bills would criminalize more of it.

What Would Have to Happen First

Voters amended the state constitution in 2018 through Amendment 3, which stripped the legislature of the power to authorize new casino gambling and handed it to the electorate through citizen initiative. Cardroom poker sits outside that definition, since the amendment excluded nonbanked card games along with pari-mutuel wagering. Whether a licensed online poker site would count is untested, and no operator wants to be the test case.

So the realistic sequence runs: the Seminole Tribe agrees to a compact amendment, the legislature writes a licensing framework, the state survives or avoids an Amendment 3 challenge, and a regulator builds a division from scratch. Each step has failed on its own. Anyone promising Florida online poker by a specific year is guessing.

How Florida Players Play Poker Online Today

Three options exist, and they are not equivalent.

Offshore rooms take real money and pay real money. They hold licenses from Curaçao or Panama rather than from any US state, they answer to no Florida regulator, and a player with a frozen balance has no agency to call. Florida sits on the accepted list for every major one, including Bovada, which turns away 19 states plus Washington, DC, after a wave of cease-and-desist letters from other regulators. Check any other tribal room directly, since each government sets its own rule.

Home games follow the cardroom line. The penny-ante statute bars anyone under eighteen from taking part, regardless of whose kitchen table hosts the game. Offshore sites set twenty-one as their own threshold in most cases, which is a company policy rather than a Florida rule.

How Florida Cardrooms Actually Work

The economics here differ from Nevada or Atlantic City in ways that affect what a player pays per hour.

Rooms charge through a percentage rake, a flat fee per hand, or an hourly seat charge, and Florida operators mix all three depending on the stake. The state taxes cardroom gross receipts at 10% and charges $1,000 per table per year in license fees, which explains why rooms with dozens of tables keep them all open even when the games are thin.

Three pieces of history explain the modern game:

1. 1996. The legislature let pari-mutuel facilities open cardrooms, with pots capped at $10. The games were nearly unplayable for anyone serious.
2. 2003 and 2007. Bet limits climbed to $2, then $5, and no-limit hold’em and real tournaments arrived in 2007 under tight structures.
3. April 28, 2010. Governor Crist signed SB 622, and on July 1 the remaining caps on bets, buy-ins, and tournament structures disappeared. Rooms set their own stakes from that day forward, which is the direct reason a $5/$10 game and a $1,300 tournament both exist here now.

Designated player games are the local oddity. In these, one seat covers the other players’ wagers without being required to, and the statute limits them to games identified in cardroom applications approved by March 15, 2018, or April 1, 2021 for substantially similar versions. Regulators have fought over these for a decade, and the Florida Gaming Control Commission continues to police where the line sits.

One more structural change reshaped the industry. Greyhound racing ended statewide after the 2018 passage of Amendment 13, and a 2021 decoupling law let pari-mutuel operators keep their cardrooms without running races at all. Several properties now exist as poker rooms with a defunct racetrack attached.

Charity and Home Poker Games in Florida

Florida has no charity poker circuit, and players moving here from the Midwest notice the absence immediately. States like Ohio and Michigan license charitable gaming rooms where a nonprofit takes a cut of a real poker game. Florida never built that framework. Charitable organizations here may run bingo and certain drawings, and poker is not among the games the statute lets them spread for profit.

What Florida does allow is the home game, under some of the most specific language in the country. Section 849.085 governs penny-ante games, and the rules are strict:

• Winnings may not exceed $10 in any single round, hand, or game
• The game must take place in a dwelling, which includes condo common areas, college dorms, and publicly owned community centers
• The host takes nothing, charges nothing, and collects no admission or rake of any kind
• Advertising for players is prohibited
• No participant may be under eighteen
• Gambling debts from the game cannot be enforced in court

That $10 ceiling is the part most hosts get wrong. It is not a $10 buy-in limit and not a $10 maximum bet. It caps the winnings from a single hand, which makes a genuine no-limit home game impossible to run inside the statute no matter how friendly the players are.

Step outside those lines and Section 849.01 applies. Polk County deputies arrested 28 people in a September 2025 operation that included keeping-a-gambling-house charges, and South Florida has produced several larger cases tying unlicensed rooms to money laundering counts. The risk falls almost entirely on whoever runs the game, not on whoever sits down.

Poker Near Florida

Most state guides send readers across a border for better action. Florida works the other way around. Georgia and Alabama residents drive south for their poker, not the reverse, and a Floridian who leaves the state is almost always going somewhere worse.

The Panhandle is the genuine exception. Pensacola sits closer to Biloxi than to any large Florida room, which makes Mississippi the practical choice for anyone living west of Tallahassee.

Responsible Gambling in Florida

Unregulated sites carry none of the protections a state license forces a room to build. They set no mandatory deposit cap, no state exclusion list reaches them, and nobody hears an appeal when a self-imposed limit quietly stops working.
