Virginia Online Poker: Offshore Tables Now, a Regulated Market One Vote Away

Two things happened in Virginia this year that tell you almost everything about poker in the Commonwealth. In September, a World Series of Poker Circuit series dealt its first hand on Virginia soil, twelve days of ring events at the Caesars property in Danville. Six months earlier, a bill that would have put licensed poker on every phone in the state passed both chambers of the General Assembly and then died in a conference committee, four days before the session ended.

So the Commonwealth sits in an odd place. Three casino card rooms deal real poker. Charities run hold’em tournaments under a permit system most states never bothered to build. Meanwhile Virginia online poker, the version most players actually want, runs entirely on sites that answer to no agency in Richmond. This page covers both sides of that gap, starting with where the law stands.

Is Online Poker Legal in Virginia?

No licensed operator deals online poker to a Virginia address. The Commonwealth regulates casinos, sports betting, the lottery, pari-mutuel wagering and charitable gaming. Internet poker appears on none of those lists.

What the statute actually prohibits

Section 18.2-325 defines illegal gambling as placing a bet on an outcome that turns at least partly on chance, and the same section defines an operator as anyone who conducts, finances, manages, supervises, directs or owns part of the enterprise. Virginia keeps a narrow exemption for contests of skill in Article 1 of the state gambling code, but no Virginia court has ever applied it to poker.

Why players and operators face very different risk

The penalties split sharply along the operator line. A player who sits in an illegal game commits a Class 3 misdemeanor under section 18.2-326, which carries a fine of up to $500 and no jail time whatsoever. That is the lightest criminal classification Virginia has. Run the game and section 18.2-328 applies instead: a Class 6 felony, with fines reaching $20,000 and one to ten years for anyone doing it as a continuous business.

Read those two sections next to each other and the legislature’s aim looks obvious. Virginia wrote its gambling code to reach the house, not the customer. Enforcement has followed that shape, landing on machines and on the people who install them rather than on individuals playing cards.

Home Games: The One Exemption Virginia Wrote Down

Section 18.2-334 runs a single sentence, and it is the only place in the gambling article where poker gets a clean pass. Nothing in the article makes it illegal to join a game of chance in a private residence, provided two conditions hold.

Two conditions carry the whole exemption:

  • The residence cannot be a place commonly used for such games, so no household hosts the neighborhood game every Friday
  • No operator can be involved as section 18.2-325 defines one, meaning nobody rakes, nobody charges for a seat, and whoever supplied the chips takes no percentage

Stakes never enter into it. A dollar-ante dealer’s choice game and a $5/$10 game among friends stand on identical statutory ground, so long as nobody profits from running the game rather than from playing in it. Move that game into a back room above a bar, charge admission, and the host has walked straight into section 18.2-328.

How Virginians Reach a Real-Money Table Today

Offshore rooms accept Virginia registrations. They hold licenses from Curacao, Panama or Kahnawake, and no Virginia regulator inspects any of them. Nobody audits the shuffle, nobody segregates the player funds, and nobody in Richmond takes a complaint about either.

Why Virginia stays on the accepted lists

This catches players who move here from a neighboring state. Virginia sits on the accepted list at rooms that shut the door on both Maryland Online Poker players and their West Virginia counterparts. The pattern across those restricted lists tracks regulatory posture rather than population. States that stood up an active gaming regulator with a class of licensed operators tend to get blocked, and Virginia has a Lottery Board that runs casinos and sportsbooks but has never licensed an online card room. No licensee is lobbying to push the unregulated rooms out.

What the absence of a regulator means in practice comes down to three things worth knowing before you deposit:

  • Argue a hand history and the only referee is the operator on the other side of the argument
  • A locked account takes whatever sat in it, and no appeal exists above the operator
  • Richmond hears nothing about any of it, since Richmond licensed none of it

None of that stops millions of hands reaching this state every week. It does mean an accepted-state list is a snapshot rather than a promise, because the roster of States With Bovada Poker shifts every time a market regulates and an operator decides to leave rather than stay.

Poker Site Reviews for Virginia Players

Four unregulated rooms deal genuine poker into this state with enough traffic to keep tables running. A long list of other brands markets poker to Virginians and delivers video poker instead, which is a paytable dressed in playing cards rather than a game against opponents. The four below put real people in the other seats.

Bovada

Offshore poker room

Welcome offer: 100% up to $500

Bovada is where most Virginians land first, and the player pool explains why. It runs on the PaiWangLuo network with anonymous tables, so there are no screen names, no tracking database and no way to build a read on a regular across sessions. Recreational players love that. Grinders resent it, which is precisely why the games play soft.

The poker welcome offer sits at 100% up to $500. Cash games start around $0.02/$0.05 and climb into mid stakes with the deepest traffic this state can reach, while the fast-fold format reseats you the moment a hand goes into the muck. Where it falls short: no stud, no razz, no mixed rotations, and a tournament schedule that thins badly outside weeknight evenings and Sundays.

Play Poker at Bovada

Ignition

Offshore poker room

Welcome offer: 100% up to $1,000

Ignition is Bovada’s sister room on the same network. Same tables, same anonymity, same software. The difference lives entirely on the promotional side, where Ignition advertises a bigger headline: a crypto deposit draws a 150% match topping out at $1,500, a card deposit draws 100% to $1,000, and an equally sized casino match sits stacked beside the poker one.

That bonus releases a dollar at a time as you accumulate points, and most players never see the full figure. Treat the headline as a ceiling, not a payout. Choosing between Ignition and Bovada from Virginia comes down to which lobby you prefer, because both seat you in the same games.

Play Poker at Ignition

BetOnline

Offshore poker room

Welcome offer: 100% up to $1,000

Of the four, BetOnline is the one where opponents carry names. It sits on the Chico network. Screen names persist, notes stick to opponents, and a meaningful share of the traffic wandered over from the sportsbook and does not fold nearly enough.

The welcome package pays 100% up to $1,000, released in stages across eight days alongside tournament tickets. Chico spreads more tournament variety than the anonymous network and posts a smaller Sunday guarantee. Its real weakness shows above $1/$2, where games break early and rebuild slowly.

Play Poker at BetOnline

BetUS

Offshore poker room

Welcome offer: Welcome bonus tied to deposit

BetUS is a sportsbook first and a card room a distant second. It reaches the same Chico pool BetOnline uses, so the games are identical, but the poker product gets less attention and the welcome package leans on sports rollover that applies across every product on the account.

Open one if you already keep a balance there. There is no poker-specific argument for choosing BetUS over BetOnline when both point at the same tables.

One structural note for anyone coming from live poker. Anonymous tables remove seat selection as a skill, because you cannot spot the weakest player at the table and move into the seat on their left. That flattens the edge an experienced grinder holds and it is the single biggest difference between these games and the ones dealt in Portsmouth.

Poker Bonuses for Virginia Players

RoomCard deposit offerCrypto deposit offerHow it releases
Ignition$1,000 poker match at 100%, matched again on the casino side$1,500 at 150% by crypto, mirrored on the casino sideOne dollar per 30 reward points accumulated

BetUSA sports-first bundle with poker folded inThe same bundle, enlarged for cryptoRollover spans the whole account, not just poker

The number that matters never appears on the banner. Ask how much rake buys one released dollar, and a $1,500 offer clearing at half the rate of a $1,000 offer turns out to be the smaller one. Then track which half of the package you are actually working through, because the poker portion usually carries no playthrough while the casino portion does, and the two sit together on a single balance where players routinely confuse them.

Operators revise these figures without notice. The mechanics behind online poker bonuses matter considerably more than the dollar amount printed on the landing page.

Virginia imposes no banking restriction of its own on any of this. A declined card comes from how the issuer codes the merchant, not from a state rule, which is why the same card clears one week and fails the next. The mechanics behind Online Poker Deposits vary far more by room than by state.

Five steps cover the whole setup:

  • Confirm the room still accepts Virginia registrations before funding anything, since accepted-state lists change without announcement
  • Register under your legal name and actual address, because a mismatch surfaces at withdrawal and freezes the payout
  • Fund with crypto if you intend to cash out, since the deposit method usually dictates the withdrawal method
  • Claim the poker portion of a welcome offer separately from the casino portion
  • Start two stakes below where you sit live, because online tables deal three to four times the hands per hour

Online Tournaments Virginians Can Enter

The anonymous network posts the largest Sunday guarantee a Virginian can enter, somewhere around $200,000, with the Chico rooms running roughly three quarters of that. Everything schedules on Eastern time, which suits this state better than it suits most of the country. Sunday majors start mid-afternoon and finish before 2am instead of grinding toward dawn.

How that compares across the state line

For scale, look west. Legal WV Poker Sites share a player pool with Michigan, Pennsylvania, Delaware and Nevada, and those guarantees rest on a regulated multi-state agreement rather than an unlicensed operator’s marketing budget. Virginia’s 2026 bills would have joined the same agreement.

Weeknight volume is the honest gap. At 9pm on a Tuesday the unregulated rooms show a fraction of their Sunday traffic, while the shared network behind Legal Poker Sites In Delaware holds steadier because five states feed it at once.

The 2026 Session: How Close Virginia Came

Both chambers passed an internet gaming bill in February 2026. The House cleared HB 161 by 67 to 30 on a second vote after the first attempt failed. The Senate’s SB 118 lost 20 to 19, returned the next day and passed 19 to 17. Then the conference committee could not reconcile the two versions, and the session ended on March 14 with nothing on the governor’s desk.

ProvisionWhat both bills did
RegulatorThe Virginia Lottery Board would issue internet gaming licenses
Who qualifiesThe five licensed casino operators, each permitted up to three online brands
Operator license$500,000 for a five-year term, renewable at half the cost
Platform fee$2 million per online brand partner
Multi-state playExplicit authority to join the agreement covering Nevada, Delaware, New Jersey, Michigan, West Virginia and Pennsylvania
ReenactmentA second vote in 2027 required before anything takes effect
Tax rateThe sticking point, with the House starting at 15 percent against the Senate’s 20 percent

The impasse was never about poker. It came down to where the tax money would land and how much protection the existing brick-and-mortar casinos would get against an online product eating their floor. Both chambers wrote a hold-harmless fund; neither would accept the other’s arithmetic. The 2026 Senate bill and its full history remain on the legislative record for anyone who wants the paper trail.

Picture what passage would actually produce: as many as fifteen online brands across five casino licensees, tables shared with the same pool Pennsylvania Online Poker players already sit in, and a reenactment clause pushing the earliest launch past mid-2027. Other states have taken somewhere between six months and a year to get from a governor’s signature to a live product, which puts a realistic first hand in 2028.

Live Poker Rooms in Virginia

Three casinos deal poker, in Portsmouth, Bristol and Danville. A fourth card room, in Richmond, runs under the charitable statute rather than a casino license.

Rivers Casino Portsmouth

Virginia’s first permanent casino opened on January 23, 2023 at 3630 Victory Blvd, and its 24-table room remains the busiest in the state. Every table carries an automatic shuffler. High-hand promotions fire constantly, $200 every 30 minutes with a $500 version every 20, which keeps seats full during hours when a room this size would otherwise empty out.

Geography does the rest. Virginia Beach, Norfolk, Chesapeake and Suffolk all sit within roughly half an hour, putting something close to 1.8 million people inside a short drive of one poker room.

Hard Rock Hotel and Casino Bristol

Bristol started first and finished last. The temporary Bristol Casino opened July 8, 2022, the permanent Hard Rock followed on November 14, 2024, and the card room now runs 14 eight-handed tables around the clock on the non-smoking floor.

It also deals the biggest game in the Commonwealth. The largest no-limit table runs $10/$25 and seats players between $1,000 and $5,000, Omaha reaches $25/$25 uncapped, and the house allows straddles, double-board bomb pots and running it twice. For a market this young, that rule set is unusually loose, and it pulls action from Tennessee and from east Kentucky.

Caesars Virginia

Danville opened a temporary casino on May 15, 2023 and its permanent resort on December 17, 2024, with a card room carrying World Series of Poker branding. In September 2026 that branding turned into something substantial, covered further down this page.

Pop’s Poker

The Richmond room at 210 Giant Drive is not a casino and does not pretend to be. It runs Texas hold’em tournaments for Good Lions Lodge #1 under Virginia’s charitable gaming permit system, four days a week, and the same statute that permits it forbids it from ever spreading a cash game.

Two more licensed operators deal no poker at all. Petersburg’s Live! Casino Virginia opened an interim hall with more than 900 slots and over 30 table games, with a card room planned for the permanent resort rather than the temporary building. Norfolk’s licensee, trading as The Interim Gaming Hall under Boyd Gaming, runs slots without a poker room.

The Geography Problem: Virginia’s Card Rooms Sit at the Edges

Here is what nobody drawing Virginia’s casino map appears to have weighed. The state authorized five host cities, and four of them hug the southern and western rim. The population does not live there.

Where you liveNearest Virginia poker roomNearest room in any state
Arlington and AlexandriaDanville, roughly four hoursMGM National Harbor in Maryland, under 30 minutes
RichmondPortsmouth, about 90 minutesThe same
Virginia BeachPortsmouth, about 30 minutesThe same
RoanokeBristol, about two and a half hoursThe same
WinchesterBristol or Danville, four hours plusHollywood Casino at Charles Town in West Virginia, about 40 minutes

Northern Virginia holds roughly a third of the state’s residents and has no poker inside a four-hour drive of its own. What it has instead is a historical horse racing venue in Dumfries and a bridge into Maryland. Most States With Poker put their card rooms where the people already are, and Virginia’s referendum-by-referendum process produced the reverse.

Poker Tournaments at Virginia Casinos

The World Series of Poker Circuit reached Virginia for the first time in 2026, and it went to Danville. Eighteen ring events ran at Caesars Virginia from September 3 through 14, carrying more than $1.5 million in guaranteed prize pools between them.

  • A $1,700 no-limit hold’em Main Event guaranteed at $500,000
  • A $600 Mini Main Event aimed at players who wanted the same structure for a third of the money
  • Ring winners collected a Bahamas package worth $5,000 alongside the jewelry

Whether Danville keeps the stop depends on how those guarantees held up against actual turnout, which is the arithmetic every Circuit venue gets judged on. A market with three card rooms and no online competition starts that conversation in decent shape.

Rivers Portsmouth carries the weekly grind instead, with a schedule built around low buy-ins and a survivor format that pays a flat number rather than a pyramid:

  • Monday, turbo events morning and evening, $90
  • Wednesday, green chip bounty and survivor, $145
  • Friday, semi-turbo, $150
  • Saturday, double green chip, $230
  • Sunday Survivor, $340, with one player in ten taking $3,000

Charity Poker in Virginia

Virginia built something most states never attempted. Section 18.2-340.28:2 lets any organization qualified to run bingo also run Texas hold’em tournaments, which pulls real poker inside the charitable gaming framework instead of leaving it to unlicensed back rooms.

The limits are precise. The statute permits tournaments and expressly bars individual poker games, so no permitted organization may spread a cash game under any circumstance. Players must be 21. Organizations either run the tournament themselves or hire a registered tournament operator, and an organization renting a room must rent it from a registered landlord.

  • Permit application: $200, payable to the Treasurer of Virginia
  • Regulator: the Office of Charitable and Regulatory Programs at the Department of Agriculture and Consumer Services
  • Use of proceeds: a predetermined share of receipts goes to the organization’s charitable purpose under section 18.2-340.19
  • Background rules: no felony conviction within ten years, and no fraud, theft or financial misdemeanor within five, for anyone working an operator’s tournaments

Pop’s Poker shows what the framework produces in practice. A permanent card room, open four nights a week for a fraternal lodge, running the same tournament structures a casino would use and legally barred from the cash games that pay a casino room’s bills.

Poker sits entirely on the 21 side of that line, whether the game runs at a licensed property or under a charitable permit. Rivers Portsmouth asks anyone who looks between 21 and 25 for a second document carrying the same name, so a lone driver’s license may not get you through the door.

Poker Near Virginia

Virginia borders five states plus the District, and the poker on the far side of those lines varies wildly.

Across the lineWhat you will findNearest crossing for most Virginians
MarylandThree card rooms: 50 tables at Live! Casino Maryland, a comparable room at MGM National Harbor, and a smaller WSOP room in BaltimoreNorthern Virginia, under 30 minutes
West VirginiaThe only regulated online poker on Virginia’s border, plus live tables at Charles TownWinchester and the northern Shenandoah
North CarolinaTribal card rooms in the far west of the stateDanville and Martinsville
TennesseeNo live poker of any kindBristol, which straddles the line
KentuckyNo casino card roomsA long drive from anywhere in Virginia
District of ColumbiaNo card roomArlington

Bristol is strange enough to single out. State Street runs down the middle of the city with Virginia on one side and Tennessee on the other, so the Hard Rock card room sits a few hundred feet from a state where poker sites in Tennessee are the only option anyone has.

Heading the other direction, poker in North Carolina means driving to Cherokee, because nothing between the Virginia line and the mountains holds a gaming license of any kind.

What Is Not Poker in Virginia

Historical horse racing

Colonial Downs operates eight gaming venues under the Rosie’s and The Rose names, spread across New Kent, Richmond, Dumfries, Vinton, Hampton, Emporia, Collinsville and Henrico. The terminals inside replay results from races already run, behind an interface that looks and feels like a slot machine. Not one of those eight deals a hand of poker.

Skill games

The machines sitting in Virginia gas stations and convenience stores are illegal, and section 18.2-325 says so by folding the term skill game directly into the definition of illegal gambling. The General Assembly passed a bill to legalize and regulate them in 2026. Governor Spanberger vetoed it on April 10, 2026, citing the absence of a single independent gaming regulator and state data showing the machines cluster in communities with higher poverty rates and lower education levels than the Commonwealth as a whole.

Sweepstakes and free-play apps

Sweepstakes poker apps operate here under no state framework at all. They run a two-currency model, one you buy and one you receive free and can redeem, and the redeemable currency is what keeps them outside the gambling statute. Virginia tried to settle the question twice in 2026 and settled neither time: SB 579 turned into a study bill, and the sweepstakes ban written into the internet gaming legislation died alongside it.

For a poker player the practical distinction is small but real. These apps deal actual hands against actual opponents. The prize pools run smaller, the traffic runs thinner, and no purchase necessary means mailing a written request rather than clicking a button.

Taxes on Poker Winnings in Virginia

Virginia taxes gambling income on a graduated scale topping out at 5.75 percent, and that top bracket opens at just $17,000 of taxable income. Anyone holding a job in the Commonwealth therefore hands over 5.75 percent of the marginal poker dollar. No separate gambling rate exists, and the Department of Taxation treats a poker score as ordinary income.

SituationHow Virginia handles it
A lottery or casino prize above $5,000The Lottery withholds 4 percent before you see it
Any smaller poker win at a licensed roomNothing gets withheld, and reporting falls to you
A win at an unregulated roomNo paperwork arrives from anyone, and the obligation survives anyway
Losses across the yearTwo federal caps bite at once: the deduction reaches only 90 percent of what you lost, and it still cannot exceed what you won

The 2026 change to federal loss deductions

Holding a loss deduction beneath total winnings is old law, and poker players have worked around it for decades. What section 70114 of Public Law 119-21 bolted onto the federal statute covering gambling losses is a second ceiling above the first: the write-off now reaches just 90 percent of what a player dropped. That percentage is the new part. It takes hold with the 2026 tax year, never applied to a 2025 return, and it stacks with the older cap rather than replacing it. Take down $50,000 across the year and give back $50,000, and only $45,000 comes off. Tax falls due on $5,000 of income earned in a year that finished level.

That arithmetic hits harder here than in a state with no income tax, and it arrives for the first time on the return covering 2026. Virginia’s itemized deduction follows the federal one, so the phantom $5,000 lands on the state return automatically and costs another $287.50 at the 5.75 percent rate, on top of whatever the IRS takes. Volume is what punishes you, which is why tournament players notice it before cash players do.

Playing across a state line

One more wrinkle for a state ringed by better poker. A session played at Charles Town or Cherokee gets taxed where it was dealt, so crossing a line for a softer game means picking up a second set of filing rules along with it.

Responsible Gambling Resources in Virginia

Call, text or chat 888-532-3500 at any hour, free of charge. The Virginia Council on Problem Gambling staffs that line.

The Lottery also runs a Voluntary Exclusion Program with two-year, five-year and lifetime terms. It reaches:

  • Casino gaming at all five licensed properties
  • Account-based lottery play and online sports betting
  • Charitable gaming, including hold’em tournaments
  • Wagering on horse racing

Notice the omission. An exclusion filed here shuts off every regulated product in the Commonwealth and touches none of the unregulated sites, which is one more practical argument for the licensed market the General Assembly keeps not quite passing.

Virginia’s Poker Players

The more Virginian story belongs to Di and Hac Dang. The brothers learned the game together online while Di studied engineering at the University of Virginia. They lost their first $200, deposited another $200, and turned that into more than $8 million each in high-stakes pot-limit Omaha before Black Friday closed the US online market in 2011. Both later coached for Phil Galfond’s training site, and Di went on to run a restaurant with locations in Arlington and Centreville.

  • Justin Bonomo, raised in Fairfax, sits fifth on poker’s all-time money list with $65,611,097 across 246 recorded live cashes
  • John Gabe Patgorski of Chesapeake has taken roughly $7.8 million from live tournaments
  • Di and Hac Dang built their bankrolls online rather than on a tournament circuit, which is why neither name appears high on a live money list

Virginia Online Poker FAQ

Does a Virginia card room require state residency?

No. The card rooms verify age and identity, never residency. Anyone 21 or older sits down at Rivers Portsmouth, Hard Rock Bristol or Caesars Virginia regardless of which state issued the license in their pocket, and out-of-state players make up a heavy share of Bristol’s traffic.

What identification do Virginia card rooms ask for?

A government-issued photo ID proving you are 21. Rivers Portsmouth asks anyone who looks between 21 and 25 for a second document carrying the same name, so one license alone may not clear the podium.

Can I enter a Virginia charity poker tournament if I am visiting from out of state?

Yes. The charitable gaming rules govern the organization running the tournament, not the people entering it. The only player-side requirement is age.

Which Virginia room suits a first-time live player?

Rivers Portsmouth. It spreads more $1/$3 tables than anywhere else in the state, which means shorter waits and a softer average table, and the high-hand drops hand you something occasionally even through a losing session. Bristol’s game runs bigger and faster, and a first-timer will feel it.

Does Virginia allow bar poker leagues that play for prizes?

It turns on whether players give up anything to enter. Section 18.2-325 builds its definition around a bet or wager of money or other consideration, so a genuinely free league awarding prizes falls outside it. Attach a buy-in, a cover charge or a required purchase and the analysis changes entirely.

Will an unregulated room send me a tax form?

No. Offshore rooms issue no W-2G and report nothing to the IRS or to Richmond. The income stays reportable regardless; the paperwork simply becomes your responsibility instead of theirs.

What happens to a balance on an unregulated site if Virginia licenses its own rooms?

Look at the states that went first. Some operators withdraw from a market once it regulates rather than draw a new regulator’s attention, and players there generally get a withdrawal window rather than a seizure. Others stay put and ignore the change. Michigan regulators leaned hard on unlicensed operators after launch, which is part of why poker in Michigan looks so different from the unregulated market next door.

Is a VPN a workaround for a site that will not take Virginia?

It is a reliable way to get an account closed and a balance forfeited. Every one of these rooms writes location misrepresentation into its terms as grounds for confiscation, and the geolocation check usually runs at withdrawal rather than at login, which is the worst possible moment to fail one. Virginia players have no reason to try it, since the rooms serving this state take Virginia registrations directly.

Would Virginians get bigger games if the state joined the multi-state agreement?

Yes, and that was the main thing the 2026 bills promised. Virginia’s roughly 8.7 million residents would rank among the largest contributors to a pool that already spans six states, which would lift guarantees and deepen mid-stakes cash traffic well beyond anything poker sites in New Jersey players saw when their own market launched alone.
