Delaware Online Poker: Legal Sites, Live Rooms, and the Law

Delaware online poker carries an odd distinction. No state legalized it earlier, and no state has spent more recent time without it. Governor Jack Markell signed the Delaware Gaming Competitiveness Act on June 28, 2012, the first sites dealt hands on November 8, 2013, and then the whole market went dark for roughly 18 months.

Hands started again on June 10, 2025. One platform now deals every regulated hand in the state, three casino brands stick their logos on it, and the opponent across the table is more likely to sit in Pittsburgh or Detroit than in Dover. Below: the statute, the site, the two racino rooms, the charity circuit that almost nobody writes about, and the specific rules that trip players up.

Legal Poker Sites in Delaware

Three poker sites accept Delaware players. All three are the same site. Delaware Park, Bally’s Dover, and Harrington Raceway each front a branded version of BetRivers Poker, and a player who signs up through one lands in the identical lobby, against the identical opponents, at the identical stakes.

Delaware sits inside a short list of legal online poker sites for US players, and it is the only member of that list where the state lottery itself owns the game rather than licensing private operators to run their own.

Why Delaware Has One Poker Site and Pennsylvania Has Six

Pennsylvania hands out licenses. Delaware runs a procurement. The lottery picks a single technology vendor through competitive bidding, that vendor builds the entire online operation, and the three racinos take a revenue share for lending their names and their gaming licenses. Competition happens once every several years, in a conference room, rather than daily in the market.

The last contest ended quietly. Seven companies applied in early 2023, 888 withdrew its own bid that May, and Rush Street Interactive stood alone by the time the lottery announced its choice in August 2023. The deal runs five years with five one-year renewals attached, so the earliest a rival could realistically take over the state’s poker traffic is 2028.

Is Online Poker Legal in Delaware?

Yes, and the statute gets there through a route worth understanding, because it explains nearly everything else about the market. Delaware never wrote a separate online poker law. It expanded the definition of the lottery instead. Section 4803(k) of Title 29 defines “Internet lottery” to cover Internet ticket games, the Internet video lottery, and Internet table games, which is how a hand of no-limit hold’em became, legally speaking, a lottery product operated by the Office of the State Lottery.

That framing has teeth. Because the lottery holds the game rather than merely supervising it, no private company can open a competing poker room in Delaware, no tribal compact creates a side market, and the state collects its share off the top rather than through a tax rate set by statute. The relevant provisions sit in Chapter 48 of Title 29, alongside the rules for scratch tickets.

Sites the State Does Not License

Delaware is a hard state for unregulated operators, and the numbers show it. Bovada names Delaware on its own restricted list, one of about 20 jurisdictions it turns away, so the states with Bovada poker do not include this one. Ignition blocks Delaware as well. For a state of roughly one million people, that is unusual: offshore rooms typically retreat only from markets where regulators have made enforcement expensive.

Sweepstakes poker met the same wall. Delaware never passed a sweepstakes ban, because the Division of Gaming Enforcement took the position that those sites already violated the existing code, and a cease-and-desist sent to VGW in April 2025 prompted a wave of voluntary exits. More operators pulled out following a second round of letters in 2026. The practical result is that Delaware players have one real-money poker option, and it is the licensed one.

Minimum Age to Play Poker in Delaware

Twenty-one, everywhere, with no softer tier hiding anywhere in the code. That matters because plenty of states set a lower bar for charity events or card rooms, and Delaware does not. Section 1566 of the charitable gaming statute states plainly that no person under 21 may take part in a Texas Hold’em tournament, which puts a church fundraiser on the same footing as the floor at Delaware Park.

Online registration enforces the same line through identity verification, and BetRivers checks a date of birth against public records before releasing a first withdrawal. A 20-year-old who slips through at signup will discover the problem when the money tries to leave.

BetRivers Poker Delaware Review

State-licensed poker room

Software and Table Format

Rush Street built this room on Run It Once software, the platform Phil Galfond developed, and that decision shapes the experience more than any promotion does. Tables use fixed 100 big blind buy-ins, so nobody sits down with 40 blinds to nit around, and nobody buys in for 300 to bully the table. Everyone starts even. Recreational players tend to like the format once they understand it; established regulars who built a career on deep-stack leverage tend not to.

HeroIQ is the other real differentiator. It is a stats display built into the client, showing opponent tendencies without third-party tracking software, and it puts a casual player on closer footing with someone running a database. No other regulated US room offers anything comparable.

Games and Stakes

The game menu is narrower than the network’s marketing suggests. No-limit hold’em runs from $0.01/$0.02 up to $5/$10, pot-limit Omaha starts at $0.05/$0.10 and holds up reasonably well thanks to the four-state pool, and seven-card stud does not exist here at all. Cub3d jackpot sit-and-gos fill the gap for players who want variance in a hurry, with buy-ins at $0.25, $1, $5, $10, and $25 and prize multipliers that top out at 1,500 times the entry. Daily freerolls carry $500 prize pools, and the Sunday Main Event guarantees $15,000.

Traffic and Revenue

Traffic remains the honest weakness, though it is improving faster than anyone predicted. Delaware’s own poker revenue came in at $53,609 during the first partial month, roughly tripled year over year by late 2025, and reached about $67,000 in March 2026. Across all four states, BetRivers cleared $900,000 in poker revenue in July 2026, its best month on record, and held a 10% share of the US online poker market. Mid-afternoon on a Tuesday, the lobby still looks thin above $1/$2.

The Verdict

For a Delaware player, this is the only regulated game in town, and it happens to be a genuinely well-built one. The software beats what 888 offered for a decade. The stakes ceiling and the missing stud tables will frustrate a small number of serious players, who mostly drive to Parx anyway.

How Delaware Shares Tables With Three Other States

A state with one million residents cannot support an online poker economy by itself. Delaware understood this earlier than anyone, which is why it signed the first interstate gaming compact in American history on February 25, 2014, and why its entire poker strategy has depended on borrowed players ever since.

The Multi-State Internet Gaming Agreement now links four markets on the BetRivers network:

  • Delaware and Nevada signed the original agreement in February 2014, with shared tables opening in March 2015, making poker sites in Nevada the first opponents Delaware players ever faced from out of state
  • West Virginia joined the compact in November 2023, then waited 19 months for a poker site to exist there, so poker sites in West Virginia and Delaware’s relaunch arrived on the same day
  • Michigan signed on in May 2022 and now supplies the largest share of the network’s traffic, which is why prime time for poker in Michigan is also prime time in Wilmington
  • Pennsylvania began shared play in April 2025, weeks before the BetRivers network launched, bringing 13 million residents into the pool

Delaware contributes maybe two percent of the players at any given table and receives access to a lobby it could never build alone. That is a fine trade, and it is the only reason regulated poker exists here at all.

Delaware Poker Bonus Offers

The Delaware welcome offer matches a first deposit 100% up to $250, using the code POKER at signup, and it releases in $5 increments for every $25 a player pays in rake across a 120-day window. Clearing the full amount means generating $1,250 in rake, which is realistic at $0.50/$1 and fanciful at the micros.

That $250 ceiling deserves an explanation, because the identical offer on the identical platform is worth $1,000 in Pennsylvania. Rush Street sizes its bonus to the size of the market, and Delaware’s market is small enough that the company would rather not fund a four-figure promotion for every new signup. Across the industry, the best online poker bonuses cluster around that $1,000 mark, which makes the Delaware ceiling the outlier it looks like. Figures move often, so treat any number as a snapshot.

iRush Rewards sits behind the bonus and matters more over a year of play. Points accumulate across poker, the sportsbook, and the casino games in one account, which suits the many Delaware players who bet football in the fall and play poker the rest of the year.

Deposits and Withdrawals

Banking here looks like banking at any state-licensed room, which is to say slower than crypto and considerably safer. One detail catches new players: no state-licensed poker site in the United States accepts Bitcoin, so any Delaware-facing site advertising crypto deposits is not the licensed one. Deposit options poker sites accept differ far more between licensed and unlicensed rooms than between one regulated state and the next.

Expect a document check before a first cashout. A driver’s license photo usually settles it, and the request arrives once rather than on every withdrawal.

How to Start Playing in Delaware

  1. Stand inside Delaware. Residency is irrelevant; a Baltimore player who drives up for the day qualifies, and a Wilmington resident on vacation does not.
  2. Pick one of the three branded sites. The choice affects the logo and nothing else, so most players take whichever racino they already have a players card with.
  3. Enter the code POKER during registration rather than after the first deposit. Applying it late forfeits the match.
  4. Install the app and grant location permission. Wilmington sits close enough to the Pennsylvania line that a phone can latch onto a tower across the border, and home Wi-Fi solves that.
  5. Keep a photo ID nearby for the verification request before your first withdrawal.

Live Poker Rooms in Delaware

The Table Game Revenue Act of 2010 let Delaware’s three racinos deal cards for the first time, and each of them ran a poker room at some point afterward. Only one still holds games a player can count on.

Delaware Park, Wilmington

The poker room occupies the second floor of Club 1 on the track side of the property at 777 Delaware Park Boulevard, and it opens daily from 10am to 3am. The room can seat 25 tables. On an ordinary weeknight, three to five of them have games, almost always no-limit hold’em at the smaller stakes, with pot-limit Omaha appearing on weekends and by request.

Do not arrive expecting a tournament. Delaware Park has built its schedule around cash games and select high hand promotion days, and the major tournament databases list no recurring events here. Calling 302-636-1050 before a long drive is worth the minute it takes.

Harrington Raceway & Casino

Call ahead before you drive to Harrington. The casino advertises a 100-seat poker room spreading Texas hold’em, Omaha, and seven-card stud, with posted hours of 2pm to midnight Thursday through Saturday and noon to midnight on Sunday. The room went dark in 2020, though, and the poker databases players use to plan trips currently show no games or tournaments running there.

One phone call settles it. Harrington sits at 18500 South DuPont Highway, roughly an hour south of Wilmington, which makes for a long evening if the tables turn out to be empty.

Bally’s Dover Casino Resort

The 18-table poker room on the third floor closed in 2019, months after Twin River Worldwide Holdings completed its takeover of Dover Downs that March. Management moved a handful of poker tables down to the main table games pit and never reopened the room. Twin River renamed itself Bally’s Corporation in November 2020, and the property has carried the Bally’s name since.

Bally’s Dover today runs close to 30 table games, a sportsbook, and harness racing, with no dedicated poker room and no announced plan to reopen one. Its name still appears on one of the three online poker sites, which is the closest thing to poker the property offers.

Poker Tournaments in Delaware

Live tournament poker is the weakest part of the Delaware scene. Delaware Park runs cash games, Harrington’s room has sat dark since 2020, and no Delaware property hosts a WSOP Circuit stop or a comparable regional series. Players chasing a decent field drive to Pennsylvania or Maryland, which takes about an hour from most of the state.

Online is where Delaware players actually find structured events, because the four-state pool makes guarantees possible that a single state could never support:

  • Sunday Main Event: $15,000 guaranteed, the largest recurring tournament on the network
  • Daily freerolls: $500 prize pools, no entry fee, open to anyone with a funded account
  • Multi-State Summer Series: Ran August 2 to 16, 2026, with more than $450,000 in total guarantees and a $200 Main Event
  • Cub3d sit-and-gos: Three-handed jackpot events at $0.25 through $25, paying up to 1,500 times the buy-in

Charity Poker Tournaments in Delaware

Delaware’s charity poker rules are more detailed than most states bother to write, and almost no poker guide covers them. The General Assembly declared charitable hold’em to be in the public interest, then wrapped it in enough restrictions that running one is a genuine project. The Delaware Board of Charitable Gaming issues the permits and licenses the dealers.

The caps that matter, drawn from Subchapter VIII of Title 28:

  • Who can run one: Veterans’ groups, religious organizations, charitable and fraternal societies, and volunteer fire companies, generally after two years of operation
  • Permit fee: $250 for each occasion
  • Entry fee cap: $150 per player per tournament event
  • Rebuys and add-ons: $25 maximum each, with two rebuys allowed during the first three hours
  • Frequency: Five tournaments per organization per calendar year, with at least 70 days between events
  • One per venue per day: Two organizations cannot share a facility on the same date, and they cannot co-host a single tournament
  • Dealers: Members of the sponsoring organization, individually licensed by the board
  • Age: 21 and over, the same as everywhere else in the state

The 70-day spacing rule is the one that shapes the calendar. It prevents any fire hall from building a weekly game under a charitable banner, which is precisely what happened in several other states before their legislatures noticed.

Home Poker Games in Delaware

Delaware never wrote a social gambling exemption, and that omission does real work. Many states carve out a private game where no one profits, listing it as a defense in the statute. Delaware’s gambling offenses run from Section 1401 through Section 1431 of Title 11, Section 1432 supplies the definitions, and no provision in that range creates the kind of safe harbor a home game host might hope for.

Section 1404 is the relevant hazard. It reaches anyone who keeps or maintains a house or place where gambling is carried on, and it does not require the host to take a cut. In practice, Delaware police do not raid friendly kitchen-table games, and no reported prosecution has turned on a no-rake dealer’s choice night. The risk climbs sharply once money changes hands for the privilege of playing, and the full text of the relevant offenses sits in Title 11 of the Delaware Code.

Poker Near Delaware

Delaware is small enough that almost every resident lives within 90 minutes of a substantial poker room in another state. Wilmington players in particular have more choice across the state line than inside it, and the Pennsylvania rooms sit closer to Wilmington than Harrington does.

RoomLocationApprox. drive from WilmingtonSize and games
Parx CasinoBensalem, PA (legal PA poker sites)35 miles48 tables, open 24 hours, the region’s deepest cash action

Horseshoe BaltimoreBaltimore, MD65 miles23-table WSOP room, $1/$3 through $2/$5
BorgataAtlantic City, NJ (poker in New Jersey)75 milesMajor tournament series host, deep weekend cash games

One warning for players who cross the line to play online rather than live: a BetRivers account funded in Delaware will not deal a hand in Maryland, because Maryland licenses no online poker at all. New Jersey does license it, but BetRivers has not launched poker there, so a Delaware account fails at the Atlantic City boardwalk too.

Taxes on Delaware Poker Winnings

Delaware taxes gambling winnings as ordinary income, with rates reaching 6.6% at the top bracket, and the state does not require casinos or the lottery to withhold anything at the point of payment. That combination catches people. A player who books a good year at Delaware Park receives no state withholding statement and still owes the money the following April.

Nonresidents owe a Delaware return on Delaware-source winnings, which is a live issue in a state where a large share of the poker economy arrives from Pennsylvania and Maryland by car. Home states generally offer a credit for tax paid to Delaware, so the money is rarely taxed twice, but the filing obligation exists regardless. Two federal changes landed for the 2026 tax year: itemizers may now deduct only 90% of gambling losses against winnings, and the general reporting threshold rose from $600 to $2,000. The IRS guidance on gambling income and losses covers the federal side, and a 24% withholding applies when winnings net of the buy-in clear $5,000.

Poker Players From Delaware

Delaware has produced no household-name professional, which is roughly what a population of one million predicts. Abraham Korotki of Bethany Beach tops the state’s all-time tournament list at around $1.9 million, built largely on one result: the $10,000 no-limit hold’em championship at the World Series of Poker Circuit stop in Atlantic City in February 2006, worth $433,008. He remains the standard other Delaware players measure against, and nobody has seriously threatened the record in 20 years.

Responsible Gambling in Delaware

Every account on the BetRivers platform carries deposit limits, session reminders, and self-exclusion settings, and the Delaware Lottery maintains an exclusion list that covers the licensed online product and the racino floors together. Setting a limit takes about a minute and cannot be reversed for the remainder of the period a player chooses.

The Delaware Council on Gambling Problems has run the state’s helpline since 1979. The number is 888-850-8888, texting reaches a counselor at 302-438-8888, and both are free and confidential.

Delaware Online Poker FAQ

I live in Maryland and drive to Delaware for work. Can I play on my lunch break?

Yes. Delaware checks location, not residency. Your account works whenever your phone confirms you are inside state lines, and it stops working the moment you cross back over the Susquehanna.

Will a VPN let me play from outside the state?

No. The geolocation software specifically hunts for VPNs, proxies, and remote desktop tools, and it blocks the session when it finds one. Repeat attempts can get an account closed with the balance frozen under the terms of service.

What happens if my location check fails mid-hand?

The client finishes the current hand, then removes you from the table and holds your stack in your account. Nothing is forfeited. Reconnect from a confirmed location and the money is there.

Do I need separate accounts for Delaware Park, Bally’s Dover, and Harrington?

No, and opening more than one would gain you nothing. The three brands feed one platform and one player pool, so a second account puts you in the same lobby with the same opponents.

Can I move money between BetRivers Poker and the BetRivers sportsbook?

Yes. One wallet covers poker, casino games, and sports betting in Delaware, and iRush Rewards points accumulate across all three.

Delaware Park’s website still mentions 888 software. Which is right?

The page is stale. 888 powered Delaware’s online poker from November 2013 until its contract expired in December 2023. Every hand dealt in the state since June 2025 has run on Rush Street’s platform.
