Hawaii Online Poker

Forty-eight states let you buy a lottery ticket. Hawaii is not one of them. Neither is Utah, and those two make up the entire list of states where a resident cannot legally wager on anything at all — no scratch-off, no bingo night at the parish hall, no $20 office pool that anybody would admit to in front of a judge. Hawaii has never licensed a single commercial gaming floor since statehood in 1959, and the prohibition is not a loophole nobody bothered to close. It is deliberate, it is written into the penal code, and lawmakers renew the argument over it every January.

So the honest starting point for Hawaii online poker is that the state regulates none of it. What Hawaii does have is a penal code chapter worth reading closely, a narrow defense for kitchen-table games that has landed people in court anyway, a police unit on Oahu that seizes gambling machines by the hundred, and roughly 2,700 miles of open water between Honolulu and the nearest legal cardroom. All four shape what playing poker actually looks like here.

Is Poker Legal In Hawaii?

No. Hawaii Revised Statutes section 712-1223 runs a single sentence, and it is unfussy: anyone who “knowingly participates in any gambling activity” has committed the offense, which Hawaii grades a misdemeanor. Poker gets no carve-out. Nothing in that sentence asks whether the game rewards skill, whether the money moved electronically, or whether the player finished the night up or down.

The one path to acquittal runs through the social gambling defense, and even that is narrower than most write-ups admit. Everything else — a raked game, a dealer working for tips, a weekly tournament in the back of a bar — sits squarely inside the prohibition.

Can You Play Online Poker In Hawaii?

Hawaii has no licensed operator, no regulator, and no bill on the books that would create either. It does not appear among the states with legal online poker sites for US players, and nothing in the 2025 or 2026 sessions moved it closer.

Residents who play online reach unregulated offshore rooms instead. Those operators sit outside US jurisdiction, answer to no Hawaii agency, and offer players no recourse if a cashout stalls. Each operator draws its own map of where it will take players. BetOnline shuts out New Jersey and nowhere else. Ignition’s blocked roster runs longer — New York, Nevada, Maryland, Delaware and New Jersey again — with Hawaii nowhere on it. The restricted-state roster set out in the Bovada poker review omits Hawaii as well. No reported Hawaii case has charged someone for playing poker on an offshore site. That reflects enforcement priorities, not permission.

Hawaii Gambling Laws, Section By Section

Part III of chapter 712 is short enough to read in ten minutes and it is where every Hawaii gambling question ends up. The definitions in section 712-1220 do most of the work, and one of them settles the skill debate before it starts. A “contest of chance” means any game whose outcome turns in a material degree on chance, and the statute adds that this holds “notwithstanding that skill of the contestants may also be a factor therein.” Hawaii wrote that clause to anticipate exactly the argument poker players want to make.

  • 712-1220 — Definitions of terms in this part
  • 712-1221 — Promoting gambling in the first degree
  • 712-1222 — Promoting gambling in the second degree
  • 712-1222.5 — Promoting gambling aboard ships
  • 712-1223 — Gambling
  • 712-1224 — Possession of gambling records in the first degree
  • 712-1225 — Possession of gambling records in the second degree
  • 712-1226 — Possession of a gambling device
  • 712-1227 — Possession of gambling records; defense
  • 712-1228 — Gambling offenses; prima facie evidence
  • 712-1229 — Lottery offenses; no defense
  • 712-1230 — Forfeiture of property used in illegal gambling
  • 712-1231 — Social gambling; definition and specific conditions, affirmative defense
  • 712-1232 — Savings promotion or prize-linked savings contest not gambling

That last entry is the single carve-out Hawaii has ever enacted, and almost nobody knows it exists. Act 253 of 2019 added section 712-1232 so that banks and credit unions could run prize-linked savings contests — deposit money, win a prize drawing — without the scheme counting as a lottery. Lawmakers wanted residents to save more. It remains the only legal way to win a cash prize by chance in this state.

One other change deserves attention. Act 249 of 2024 trimmed the definition of “advance gambling activity,” removing language that had reached a person who simply made no effort to stop gambling on premises they controlled. That narrowing carries an expiration date: on July 1, 2029, the old and broader wording returns automatically unless lawmakers act again.

What Happens If You Get Caught

Hawaii made its gambling penalties considerably harsher in 2022, and the change gets almost no coverage. Act 111, Session Laws 2022 rewrote the promoting offenses after legislators found that armed robberies, stabbings and shootings around illegal gambling houses had become routine, and that those houses doubled as drug and trafficking sites.

OffenseStatuteGrade before Act 111Grade nowState of mind
Promoting gambling, first degree712-1221Class C felonyClass B felonyRecklessness
Promoting gambling, second degree712-1222MisdemeanorClass C felonyNegligence
Gambling (playing)712-1223MisdemeanorMisdemeanorKnowingly

Read the third column against the fourth. Running a game in Hawaii moved from a misdemeanor to a class C felony, and the prosecution no longer has to prove you knew what you were doing — negligence suffices. Anyone who has ever thought about hosting a game with a rake should sit with that for a moment.

Home Poker Games And The Social Gambling Defense

Section 712-1231 is the reason Hawaii home games exist. It is an affirmative defense, not an exemption, and the distinction matters enormously: police can still arrest you, prosecutors can still charge you, and you carry the burden of proving the elements by a preponderance of the evidence at trial. The statutory conditions for social gambling all have to hold at once.

  1. Players compete on equal terms with each other.
  2. No player receives anything of value or any profit beyond that player’s own gambling winnings.
  3. No other person, corporation, association or entity receives anything of value or any profit, directly or indirectly, from any source — the statute names use of the premises, refreshments, food, drinks, service, lodging and entertainment.
  4. The game is not played in a hotel, motel, bar, nightclub, cocktail lounge, restaurant, massage parlor, billiard parlor or any business establishment, nor in a public park, public building, public beach, school ground or church.
  5. None of the players is below the age of majority.
  6. The activity is not bookmaking.

Condition three is the one that trips people up, because the statute reaches further than a rake. A host who charges for the beer, a friend who takes a free seat for organizing, a landlord who collects rent on the room — each of those breaks the defense outright.

Then there is the limit nobody mentions. Section 712-1231 makes the defense available in prosecutions under sections 712-1223, 712-1224, 712-1225 and 712-1226 only. It does not reach the promoting offenses. A host charged under 712-1222 cannot raise social gambling at all, which means the person who organized the game faces a class C felony with no access to the very defense that protects everyone sitting at the table.

The Maui Raid That Tested It

On August 28, 2012, the Maui Police Department’s Vice, Gambling and Morals Unit served a search warrant on a home belonging to 35-year-old Khanhnha Vanhtha and found a poker game running in the living room. Officers arrested nine people. Vanhtha faced promoting gambling in the second degree plus possession of a gambling device on $400 bail; the other eight sat at $200 apiece. The Maui Poker Association argued publicly that the game satisfied 712-1231 and broke no law. Note where the charges landed, though: the eight players could raise social gambling, and Vanhtha, charged with promoting, could not. Everyone made that argument after the handcuffs came off, which is the whole point about affirmative defenses.

The Minimum Age To Play Poker In Hawaii

Hawaii sets no gambling age, because the state licenses no gambling to set an age for. The only statutory number that touches poker is the one buried in condition five of the social gambling defense: no player below the age of majority. Section 577-1 fixes that at eighteen.

Unregulated offshore rooms set their own floor, and every major one serving the islands uses eighteen as well. That number comes from the operator’s terms of service, not from Hawaii law, and it carries none of the identity-verification requirements a regulated market would impose.

Live Poker Rooms In Hawaii

There are none. Not a tribal room, not a cardroom, not a racetrack with a poker annex — Hawaii has no federally recognized tribe holding land in trust, so the compact route that produced rooms in California and Washington was never available here. The last legal wagering in the islands is a century gone. King Kalakaua helped organize the Hawaiian Jockey Club in 1872 and later set the racetrack oval at Kapiolani Park, which ran until 1926; the Oahu Jockey Club opened in 1939 and the Kailua track closed in 1949. Nothing licensed has replaced them.

What exists instead is a private circuit: home games, dealer-and-table rental outfits that supply equipment for them, and informal groups that organize through local meetups. All of it lives or dies on whether the game clears the six conditions above.

Why There Is No Gaming Floor Even At Sea

Cruise passengers expecting the usual shipboard tables find the room shuttered in Hawaiian waters. Section 712-1222.5, added by Act 196 in 1990 after legislators concluded that intrastate gambling junkets would damage a family-oriented tourism industry, makes it a class C felony to operate a gambling ship or to permit gambling on any craft that embarks and disembarks within the state.

The precision matters. Subsection (3) exempts travel to or from a foreign nation or another state, so a ship sailing in from Vancouver or Ensenada may run its tables until it reaches state waters. What the statute kills is the round trip that begins and ends in Hawaii. That is why Norwegian’s Pride of America, the US-flagged ship homeported in Honolulu that circles the islands and never touches another port, sails with no gaming room at all. No slots, no tables, not even bingo.

How Oahu Polices Its Game Rooms

Prohibition did not eliminate the demand; it pushed it into storefronts. The Honolulu Police Department’s Narcotics/Vice Division runs a dedicated Gambling Detail that serves warrants on game rooms almost weekly, and through mid-July of 2026 it had hit 30 of them, seized 451 devices and made arrests on charges including promoting gambling in the second degree and possession of a gambling device. The city says its game room task force has shut roughly half of Oahu’s gambling dens since it launched.

City Hall then went after the buildings rather than the operators. Mayor Rick Blangiardi signed three game room ordinances on June 20, 2025: one requiring a permit from the police chief for electronic gambling devices, one letting the Department of Planning and Permitting refuse permits on any property cited for a gambling-related nuisance in the prior two years, and one raising penalties for unpermitted work at those addresses. City records tally roughly $6.65 million in fines against properties tied to alleged game room activity.

The Fantasy Sports Ruling That Set The Tone

If you want a single document that explains how broadly Hawaii reads its own gambling law, read the one the attorney general issued in January 2016. Responding to an inquiry from Sen. Rosalyn Baker, AG Doug Chin concluded that daily fantasy sports contests are gambling under Hawaii law, writing that the technology had changed but the vice had not. The attorney general’s news release laid out the reasoning in plain terms.

Honolulu Prosecutor Keith Kaneshiro followed within days with cease-and-desist letters, and DraftKings and FanDuel pulled out of the state. Both remain out. An activity that dozens of states treat as a game of skill outside their gambling codes is, in Hawaii, simply gambling — which tells you how a Hawaii prosecutor is likely to treat a skill argument about poker.

Charity Poker Tournaments In Hawaii

Hawaii offers no charitable gaming exemption of any kind. A canoe club cannot run a poker night, a school booster group cannot sell raffle tickets, and a church cannot hold bingo. Nonprofits here raise money through auctions and direct appeals because the gaming route that funds fire departments and youth leagues across the mainland is closed off entirely.

That places Hawaii alongside the only other state with a comparable blanket prohibition, where the same restrictions govern the best poker sites in Utah conversation. Two states, one legal posture, and no charity table in either.

Tournament Poker And The Players Hawaii Has Produced

No tournament series can legally run in the islands, so Hawaii’s tournament record was written on the mainland. It is a better record than a state of 1.4 million people with zero infrastructure has any business posting.

Hamilton took the state’s first bracelet in 2009, and she did it in her first live tournament. Heads-up against Lori Bender both players turned over pocket eights; Hamilton’s queen kicker played. McCue-Unciano’s Monster Stack win a decade later made three bracelets for Hawaii and turned a Kapolei grinder into a millionaire in a single afternoon.

Poker Near Hawaii: The Ninth Island

Ask a Honolulu player where their home game is and a fair number will name a room in downtown Las Vegas. The link is deliberate and it is nearly fifty years old. Sam Boyd opened the California Hotel in 1975, found the Southern California crowd he was aiming at was not showing up, and turned his marketing toward Hawaii with charter packages priced as low as $9.90 in airfare. Vacations Hawaii still runs 767 charters out of Honolulu to Boyd’s downtown properties several times a week, and Clark County now holds one of the fastest-growing Native Hawaiian and Pacific Islander populations in the country. Locals call it the ninth island without irony, and it explains why the rules governing Nevada online poker matter to more Hawaii residents than those of any other state.

The alternative is a shorter hop to Los Angeles. The enormous cardrooms in Commerce, Bell Gardens and Hawaiian Gardens spread limit and no-limit around the clock, under the same statutes that shape California online poker and its live market. Either way, playing a real tournament means buying a plane ticket first.

Sweepstakes And Free-Play Poker In Hawaii

Sweepstakes platforms reach Hawaii through a different legal theory. Players buy a play-money currency and receive a second, promotional currency that can be redeemed for cash prizes, and the operators argue this makes the games promotional contests rather than wagers because no purchase is required to obtain the sweepstakes currency. Hawaii courts have not tested that argument.

Lawmakers have started looking. SB 3281 in the 2026 session would have created an offense for promoting illegal electronic gambling devices, with language reaching sweepstakes gambling machines; it cleared the Senate unanimously before the House Committee on Judiciary and Hawaiian Affairs deferred it. Free-play apps carry none of this ambiguity, since nothing of value moves in either direction.

Offshore Poker Site Reviews

Hawaii sits five or six hours behind the East Coast depending on the season, and the state observes no daylight saving time, so the gap widens in summer. That single fact does more to shape a Hawaii player’s results than any welcome bonus. When Honolulu sits down at 8 p.m., New York is asleep and the lobbies have thinned. Every review below is written with that in mind.

Ignition

Offshore poker room

Welcome offer: 100% up to $1,000

Nowhere else are the games this soft, and the gap is wide. The hidden virtue for an islander is the seating: screen names stay hidden, so nobody accumulates a read on the Honolulu account that logs in at the same odd hour every night and nobody follows it from table to table. That protection is worth far more here than in Chicago, where a player can simply pick a different table at a busy hour. Zone Poker keeps a fast-fold pool alive past 11 p.m. island time, which is often the only thing still breathing. Tournaments are the weak spot — sparse compared to what the bigger unregulated networks list — and the withdrawal ceiling wears on anyone who wins steadily. A casual player in Kailua should still start here.

Play Poker at Ignition

Bovada

Offshore poker room

Welcome offer: 100% up to $500

One pool, two doors. Bovada shares Ignition’s tables and its hidden seating, so hunting for a difference in game quality wastes an afternoon. The separation is what wraps around the poker client: Bovada bolts on a sportsbook, and Hawaii is a state where residents cannot place a regulated sports wager anywhere, on any app, at any age. That makes a combined account more useful in Honolulu than it would be in Denver or Detroit. Decide on the promotion you will realistically finish, then stop deliberating.

Play Poker at Bovada

BetOnline

Offshore poker room

Welcome offer: 100% up to $1,000

Tournament players in the islands get the most from this one. Its guarantees post at hours that suit the Pacific — a late registration from Hilo does not require staying up until sunrise, which the East Coast-anchored schedules elsewhere effectively demand. Cash tables run thinner and the regulars who sit at them play a sharper game than the Ignition crowd. Withdrawals in crypto clear quickly, which matters in a state with no local recourse if they do not. Register for the tournaments; grind your cash volume somewhere softer.

Play Poker at BetOnline

SportsBetting.ag

Same ownership as BetOnline, same players, same tournament calendar. Holding both accounts accomplishes nothing except splitting a bankroll across two cashiers. The client looks its age, and poker plainly came second to the betting lines during its design.

Play Poker at SportsBetting.ag

Americas Cardroom

Offshore poker room

Guaranteed prize pools here dwarf the rest of the list, and rakeback rather than a signup match is where the value actually sits. Run the arithmetic against your own schedule before signing up. Professionals populate these tables in numbers the other rooms do not see, so a Maui player squeezing in four hours across a week will lose the rakeback edge to the difficulty of the games. Twenty hours a week changes that calculation entirely.

Bonuses And Banking For Hawaii Players

Headline offers sit around 150% up to $1,500 at Ignition, 100% up to $500 at Bovada and 100% up to $1,000 at BetOnline, each opening at a $10 deposit. Those numbers drift, sometimes within a single month. The figure that decides an islander’s result, though, is ongoing rakeback, and the reason is the clock. A match bonus releases in increments as you generate rake; generate it slowly and a $1,500 headline expires with half of it unclaimed. Honolulu generates it slowly, because the busiest tables shut down around dinnertime here. Weigh the best online poker bonuses by how fast the increments actually release.

Funding an account from the islands means cryptocurrency in practice. Card attempts to unregulated operators bounce often enough that most Hawaii players stop trying after the second decline, and nobody in the state government will take the call when a withdrawal sits pending for three weeks — no gaming commission exists here to take it. Sort out the deposit options poker sites accept while the balance is still zero.

Taxes On Poker Winnings In Hawaii

The state runs twelve income tax brackets, more than any other, and the top one takes 11%. A thirteenth bracket at 13% on single-filer income above $400,000 switches on in tax year 2027. Hawaii collects no gambling tax whatsoever, which follows from collecting no gambling revenue, but a poker score is ordinary income here and the department treats it that way.

Now the part that stings. Nevada imposes no personal income tax, so a Las Vegas resident who ships a bracelet event keeps the whole number. A Kapolei resident who ships the identical event on the identical day owes Hawaii up to 11% of it, because Hawaii taxes what its residents earn regardless of which state the chips sat in. Anyone flying to Vegas for a serious buy-in should price that difference into the trip before boarding.

Hawaii Online Poker Legislation: 2025 And 2026

Two consecutive sessions produced more gambling legislation than the previous decade and enacted exactly none of it. The pattern is consistent: bills clear one committee, stall in the next, and die when the session closes.

  • 2025, HB 1308 — sports wagering; advanced further than any prior gambling measure before House and Senate negotiators deadlocked on tax rate and regulatory structure. Died when the session adjourned on May 2, 2025.
  • January 26, 2026, HB 1945 — cruise ship gaming in state waters from August 2027 at a 20% wagering tax, introduced by Rep. Tam and eight colleagues. The Economic Development and Technology committee deferred it on February 11, with Rep. Greggor Ilagan, a co-introducer, chairing the committee that shelved it.
  • January 28, 2026, HB 2570 — sports wagering under DBEDT, introduced by Reps. Holt, Kahaloa, Keohokapu-Lee Loy, Morikawa and Olds. It would also have created a Problem Gambling Prevention and Treatment Special Fund. Cleared ECD 4-3 on February 11, passed second reading the next day over 20 no votes, and then sat in Judiciary and Hawaiian Affairs until the session ended.
  • 2026, SB 3303 — companion to HB 2570; stalled in Senate Judiciary in April without a floor hearing.
  • 2026, HB 2222 — one Honolulu venue under a new Hawaii Gaming Control Commission, $1 million application fee. No movement after January 30.
  • 2026, SB 3268 — a single 20-year license in the Stadium Development District. Referred to two joint Senate committees; never scheduled.
  • 2026, HB 1434 and SB 1507 — a Hawaii Lottery and Gaming Corporation to run and regulate wagering. Neither gained traction.
  • 2026, HB 2198 — classifies online prediction markets as illegal gambling; passed Consumer Protection and Commerce 11-0 on February 5. The one gambling bill moving in the restrictive direction.

The measure status record for HB 2570 shows the arc plainly. Senate President Ronald Kouchi has voiced reservations about the social costs of expanded access, and the Hawaii Coalition Against Legalized Gambling, backed by religious and community health groups, has lobbied against every version. As of the fall of 2026 the state has enacted nothing. Poker is not even the subject of these fights — sports wagering is, and poker would trail it by years if the first domino ever falls.

Responsible Play And Getting Help In Hawaii

Prohibition produced a gap that almost nobody names out loud. Most states pay for problem gambling treatment by earmarking a slice of the revenue their licensed operators generate. Hawaii licenses nobody, collects nothing, and therefore built no program, no state helpline and no mechanism to pay for either. The irony runs deep: the state most opposed to gambling offers its residents the least help with it. HB 2570 carried a Problem Gambling Prevention and Treatment Special Fund inside the Department of Health, and that fund died in committee along with the sports wagering it was attached to. Until something passes, islanders lean on federal behavioral health block grants and on counselors who treat gambling disorder as one item on a longer list.

  • National Problem Gambling Helpline: 1-800-GAMBLER, answered around the clock

Hawaii Online Poker FAQs

Has anyone in Hawaii been charged just for playing on an offshore site?

No case is on record. Enforcement targets operators, hosts and storefront game rooms, not individuals sitting at a laptop. That reflects where prosecutors choose to spend their resources, and it could change without any change to the statute.

Do the rules change from island to island?

The statute is identical statewide. Enforcement is not. Honolulu runs a dedicated police gambling detail plus a city permitting apparatus aimed at game rooms; Maui has its own vice unit with a documented history of serving warrants on private residences. Kauai and Hawaii Island generate far fewer gambling cases. Same law, different odds of a knock at the door.

What happens to cash and chips police seize?

Section 712-1230 lets a court order forfeiture of the money staked, the chips, the cards, the furniture and even the vehicle or vessel involved, subject to the procedures in chapter 712A. The forfeiture track runs separately from the criminal case, so losing the cash does not depend on a conviction.

Does Hawaii block payments to unregulated poker sites?

The state operates no payment-blocking list and instructs no bank to screen transactions. Declines happen anyway, because card issuers apply their own merchant-category rules to offshore gaming processors nationwide. That is a bank policy, not a Hawaii one.

Can a mainland visitor sit in a local home game?

Residency is irrelevant to the statute. A visitor from Oregon in a Waikiki home game faces the same misdemeanor exposure as the host’s neighbor, and the same six conditions determine whether the social gambling defense is available to everyone at the table.

Is Hawaii’s isolation really that different from other states without poker rooms?

Yes, and the comparison that makes the point is poker in Alaska, the only other state where residents cannot simply drive across a border. A player in Idaho or Utah reaches a legal room in a few hours by car. From Honolulu, the cheapest legal seat in the country is a transpacific flight away.
